A litigation attorney with a wide range of experience, Trajan Perez concentrates his practice on defending cases involving allegations of product defects, environmental and natural resource damages, toxic tort, as well as representing companies in commercial disputes.

Protecting the Product and the Bottom Line

Defending manufacturers, distributors and retailers in a range of product liability actions, Trajan works to achieve cost-effective dismissals and settlements in two-party, multiparty, complex, MDL and class action cases. He regularly manages risks in catastrophic injuries alleged in “bet the company” product liability cases.

Environmental Representation for Global Oil and Local Agencies

Trajan’s environmental litigation practice involves representation of global corporations, regional companies, and “mom and pop” businesses in matters at the federal and state level. He has extensive experience in CERCLA, RCRA, HSSA, Brownfield Acts, and common law claims associated with environmental contamination.  Trajan’s experience includes negotiation agreements directly with enforcing agencies, negotiating allocations with additional potentially responsible parties, and serving on PRP group committees and as the chairman for one PRP group.   In addition, he serves as regional UST counsel for a global oil company, handling UST matters throughout California on their behalf.

Environmental Law

  • Trajan serves as California regulatory counsel for BP’s Underground Storage Tank (UST) matters.  In this capacity, he is responsible for handling multiple aspects of UST Sites including site characterization and remedial plan development, regulatory agency interface, third-party damage claims, and allocation of liability among contributing parties. 
  • Trajan represents a variety of clients in CERCLA and other environmental enforcement actions.  Representation includes interfacing and negotiating with enforcement agencies prior to enforcement actions as well as litigation with agencies and other PRPs when necessary.
  • He has negotiated allocation issues at multi-party environmental sites based on toxicity, volume, time at site, ownership and other criteria and always endeavors to position clients in the best possible manner given the facts of any particular site.
  • Trajan has extensive experience in litigating and resolving common law property claims against clients including continuing and permanent nuisance and trespass claims.

Product Liability

  • Trajan has represented Wyeth in phen-fen litigation and participated in numerous trials throughout the United States
  • He defended Wal-Mart in ephedra litigation
  • Trajan represented Tyco Medical in medical equipment product liability cases
  • He defended Tyco in sprinkler and alarm product liability litigation
  • He recently represented Fenimore manufacturing in industrial product liability case
